Our Texas Family Code presumes that parents will have joint custody or Joint Managing Conservatorship. However, one parent is usually given the exclusive right to determine the primary residence of the children which means determine where the child will live. The other parent is usually given what is referred to as a Standard Possession Order and is obligated to pay child support. Now, there are many factors that go into determining which parent is awarded what rights and what obligations. Often, we can negotiate or obtain in court a final order that is customized to each parent's needs and desires and is not some cookie cutter order designed to fit all. In addition, there is no presumption that moms will automatically win child custody and we have successfully won child custody for many dads in the past.
