How to Prepare for a Texas Divorce

If you are contemplating a divorce, or believe your spouse may be contemplating a divorce, there are several steps you want to take to protect your interests, including dealing with:

  • Contact Information — You will want to watch the mail and access computers or contact lists to obtain the names, addresses, phone numbers and account information for all assets and debts, such as a home mortgage, bank accounts, credit cards, insurance, pensions, stocks and bonds, loans, investments, and other assets and bills. If possible, you should make copies of this information and have your lawyer store them.
  • Credit Cards — You will want to make sure you keep an eye on any joint credit cards to ensure your spouse doesn’t make substantial purchases. You may want to even consider cancelling joint credit cards at some point.
  • Safe Deposit Boxes — You will want to inventory the contents of any safe deposit boxes, and may also want to consider removing any valuables and storing them in an alternative location (perhaps a different safe deposit box) for safekeeping.
  • Investments — You will want to inventory all investments, including stocks, bonds, property holdings, collectables and other valuable assets.
  • House — You will want to maintain your presence in the family home, if possible.
  • Retaining an Attorney — You will want to speak with and retain an experienced Texas divorce lawyer to discuss your intentions and help you understand your options and the potential benefits and ramifications of certain actions. Everything you say to your attorney will be kept in strict confidence, and the sooner you engage an experienced family law attorney and divorce lawyer, the better.
